The example in business would be something like a store hiring goons to strip-search shoplifting suspects ... do you sue the goon ... or do you sue the store ... the goon is an escaped murderer, and the store knew it ... and this is the store's 41st time committing rape ...

Police departments should have written policies concerning behavior and conduct of their officers ... if the individual officer violates these policies, then they should be liable ... the "qualification" for immunity is when the officer is within these policies, then it is the writer of these policies that are liable, typically the City Council ...

Bowie County keeps re-electing Sheriff Buford T. Justice ... the tyranny of the majority ... so we sue Bowie County ... simple ...

Because all the empirical evidence over the 50+ years since Earl Warren presented the sophistry of QI has shown that cops WILL abuse the notion, and in fact HAVE violated countless civil rights a countless number of times. Cops have used QI as a shield to commit crimes. So we're talking about what we've seen in the laboratory of life.

It might make some feel good, but the humans in uniform have not risen to the occasion of demonstrating respect for the rule of law and respect for the rights they are supposed to be protecting.

We're gonna protect our good police don't you think? ... does the beat cop lose his house because the DA made a stupid mistake? ... the reading I've been doing seems to indicate QI is strictly for civil cases ... if a police officer breaks the law, QI shouldn't be applied ... the sheriff deputies caught unloading a boat full of cocaine were sent to jail ... no QI ... however, the dock owners can't sue the deputies because the deputies were under orders from the elected sheriff to unload the boat at the docks ... the dock owners sues the County ... as the County is responsible for their employees while they're about their official business ... and maybe the County shouldn't be in the drug smuggling business if they don't want to get sued ...

Do you sue the guy at Walmart checking receipts, or do you sue Walmart for hiring a guy to check receipts? ...

Are the COURTS abusing this ... sure, I agree ... all the incidents you bring up will ALL include a court-of-law ...

Maybe, just maybe, your problem is with the court-of-law that allows abuse of QI ... because ALL good police officers deserve protection from us against lawsuits ... folks can sue the government for act committed by the government ... and government employees deserve the same protection that private sector employees get ...

No it does not make that assumption, never stated never implied.

My point is that evidence shows that MANY, not all, cops do break the law, do abuse QI, because they know they can get away with it.

Perhaps you can explain the good that has been done for society by QI.......why do we need it? What good purpose has it served in all these years?
