How does the supreme Court determine these things on a case by case basis ?? Doesn't the supreme Court mostly look at cases that would set precedence for the people and the nation (larger impact) instead of being bothered by individual cases that can be handled in the lower courts ?

Violating the due process clause of the Fifth Amendment of the U.S. Constitution:

The Fifth Amendment says to the federal government that no one shall be "deprived of life, liberty or property without due process of law."
He was not adjudicated to be a prohibited person who could not possess firearms, an order was issued without him being allowed to defend himself or face his accusers, which resulted in the suspension of his second amendment rights for a year.

This is what is disturbing about this action not his political affiliation or him being a threat to certain segments of the population (wanting to incite a race war). If he's as violent and as much of a threat as law enforcement is portraying him to be they should have been able to do what they needed through regular legal channels but I believe the first article I read stated that the government did not have sufficient evidence to do so.

EXACTLY what we said would happen. First a VETERAN school crossing guard and now someone who had his guns ILLEGALLY taken completely based on his political beliefs and affiliations. This is EXACTLY why they wanted these unconstitutional laws and why they want ALL guns to be registered and bought through people/businesses who have to keep record of who is buying them. Of course on both sides the short sighted mentally deficient won't care about this because his political affiliations hurt their delicate feelings,they won't care until a GOP governor or administration tries taking them from leftists and the GOP lovers won't care until a leftist governor or administration tries taking them from republicans and conservatives. This is a VERY slippery slope that is HIGHLY unconstitutional.

Wait a minute. This guy wasn't exactly Uncle Charlie cleaning his antique gun collection down in his basement. This guy was the active head of a group who was showing every sign of practicing and organizing for mass killings, and was already suspected tied to several murders.

I agree I don't like the idea of this, but this guy's "political views" were violent and terroristic in nature. Had they done nothing and this guy went on to kill a bunch of folks and it came out they had known about this guy, there would be outrage everywhere at the ineffectiveness of law enforcement to protect the public!

SEATTLE — A notorious neo-Nazi whose antics have included organizing paramilitary exercises in the woods of western Washington state to prepare for a “race war” has discovered there are limits to organizing violent extremism. Using a so-called “red flag” law, Seattle Police have taken away all of his guns.

Kaleb J. Cole, the 24-year-old leader of the state’s chapter of the violent fascist group Atomwaffen Division (AWD), was ordered by the state’s civil courts to surrender his guns earlier this month, according to a report from Ali Winston of The Daily Beast. The order resulted from Seattle City Police filing an “Extreme Risk Protection” petition against Cole on the basis of his violent rhetoric and organizing.

Cole first came to national attention last year as one of the ringleaders of the neo-Nazi group Atomwaffen Division, exposed in a deep Pro Publica profile of the organization already associated with several murders. A video portrayed him leading a shooting exercise in the woods near the town of Concrete, in the western Cascades Range. He is formerly from the border town of Blaine in Whatcom County, but reportedly moved to Snohomish County near Arlington after the profile was published.

Washington’s “red flag” law allows law enforcement or civilians to obtain a court order to confiscate weapons when there is evidence that people are at high risk of harming themselves or others. A similar law in Oregon was recently used to confiscate the weapons of another right-wing extremist, Marine Sgt. Michael Kohfield, who had announced his plan to hunt down and murder antifascists in their homes.

Western Washington has been plagued with the presence of a number of far-right extremists and their organizations the past several years, including street-brawling groups such as Joey Gibson’s Patriot Prayer and the Proud Boys, as well as more violent paramilitary organizations such as Atomwaffen Division and The Base, which recently began holding training exercises in the state’s northeastern corner.
