When a person is on probation, he is not innocent. He's already been convicted of a crime, and probation is all or part of his sentence for being convicted of that crime. He is obligated to fulfill the requirements of his sentence. That includes adhering to the conditions of his probation.

He's in jail because the judge said that he was a threat to public safety. What he SAYS poses a threat to public safety. And, it isn't even so much that he's in jail for probation violation. He's in jail until after the election because the government does not want a HEARING until after the election. The judge does not want his defenses to be made public. How did this happen? There really was a probation violation hearing two days after his arrest. One of the charges against him was that he used an alias. During that hearing it was proved that he legally changed his name from Nakoula Nakoula to Mark Youssef and his probation officer not only knew it, but approved it. A recess was granted and that's why he's in jail now. The hearing is in recess. This was all over the local news.

Who dubbed the movie into arabic? Who posted it to the internet? Who made copies and distributed those copies to mosques throughout the middle east? The people who were rioting never saw the internet video. They were told about it from the imams who had seen the distributed copies. Do you think that obama actually wants that information to come out before the election?

He's not in jail because he violated the terms of his probation. That's the point. The hearing to determine whether or not he violated the terms of his probation hasn't been completed. It was stopped as soon as the Federal Government was unable to prove up their first violation. He's in jail pending a hearing on whether he violated his probation.

That's the part you are missing and I'm not at all surprised that you would do that. There is a probation violation hearing set, and there was in the case of the filmmaker. The difference is that his hearing was stopped when the first allegation of violation was dismissed. It is in recess until after the election.

If the terms of the probation is not to use the internet, then he would absolutely be in violation if he did that. But that hasn't been proven yet. He's as innocent of violating the terms of his probation as he was innocent of the original charge before he went to trial on that.

He's in jail now because his defenses might impact the election. That's why he's in jail. He will be in jail until his defenses no longer pose a danger to obama's reelection. That's why the hearing is scheduled for after the election when it won't matter.

He could not possibly be arrested for uploading the film to the internet. He could be arrested for suspicion of having uploaded the film to the internet. He hasn't uploaded the film until it is proved that he did that. The federal government will have an opportunity to provide that proof at the probation violation hearing.

One of the terms of his probation was that he was not to use any aliases. He was using the name Mark Yousef. That would be a violation of the terms of his probation except that when the violation hearing occurred, it was proved that he had legally changed his name, his probation officer knew it and approved it in writing. That charge was dismissed. The hearing was put in recess and continued until after the election because of the risk of danger that he could likewise prove that he didn't violate the terms of his probation.
