The best way to reduce divorce rates and to discourage gay marriage is to bring back "no fault divorce" laws. Cheating on your wife or husband is a "breach of contract" and the guilty party should be held liable and forced to pay damages.

The promise of sexual exclusivity (fidelity) is a very important part of marriage. This needs to be clearly written into all civil marriage contracts and enforced by the divorce courts. Marriage is about rights and responsibilities to each other. Modern society has taken all of the responsibility out of marriage. If people were held accountable for their actions, we would see much fewer divorces and much fewer gay men would be interested in marriage.

And why is that? (By the way, don't forget women can be gay, too).

It's true- No fault divorce was sold as a way to end back-logs in courts... all it did was increase family law cases and accelerate the ease of divorce... When marriage is made cheap it is treated as such.

The outcome will be like this

Because traditional marriage is failing and gay marriage has a higher chance for success.

So if one partner cheats, rather than just end it and both get on with their lives, you think they should drag it out with unproven accusations, unproven counter-accusations and lots of hostility would improve the situation?

If one of them is cheating, chances are pretty good that the marriage is over. Aside from some men out for sexual conquest, marital infidelity is a symptom of other problems in the relationship. Dragging out the divorce process is not going to help.

No, but the cheater would lose their proverbial shorts financially- that's what happens when you break a contract. The innocent party prevails. The cheater can go off and cheat to their hearts content- but when there is accountability to the contract, it is taken more seriously- that's a fact. Divorce rates skyrocketed due to to NFD laws

The problem is not whether or not you punish the one who cheated, but whether you create more hostility in a situation involving children. It also involves accusations and counter-accusations.

She accuses him of cheating. He accuses her of creating a hostile environment at home. Then he accuses her of cheating. She says he cheated first ect ect.

I don't think No-Fault divorce is the only option. If the injured spouse wants to go after the assets they can. Most choose not to do so.

But you want to force them to do that?

Correct. The OP has once again demonstrated reactionary idiocy.

You clearly have no idea what you’re talking about.

Marriages end for scores of other reasons having nothing to do with infidelity or contract violations. Forcing couples to stay in marriages which have clearly ended is needlessly cruel. No-fault divorce allows adults to amicably agree to end a contract neither benefits from.

I find it rather amusing that conservatives continually ridicule liberals for wanting the gov't to fix everything for them. They make fun of them for "nanny state" remarks.

And here, these social conservatives want the gov't to interfere in people's marriages and divorces. They want the gov't to make it harder to get a divorce, in hope of lowering the divorce rate.

It's only big government when they disagree with it.

Wow, small government legislating people's lives. Nice. Kinda expected from the Christian Taliban.

It’s actually consistent with conservative authoritarianism, their desire for conformity, their disdain of individualism.

In this case a couple’s right to dissolve their marriage contract in good faith, thus avoiding needless distress and expense.

You are forgetting the innate need to see people punished for their immoral act of divorce.

True, punished for being ‘weak,’ ‘selfish,’ and ‘self-centered.’

Deliver us from the arrogance of the moralistic right.

their disdain of individualism. .

Are you kidding?! Liberals don't even believe individuals exist. People can only be considered (and treated) as members of a (aggrieved or guilty) group.

Excuse me? Have you been reading this thread? The social conservatives have raved about how gays are more likely to commit suicide, more likely to abuse drugs, and have a higher percentage of this & that. In other words, they used these as reasons to deny gay marriage. No one claimed all gays are mentally ill, suicidal, or child molesters, but since their demographic has a higher rate of these things, they convict all gays of them. Some celebration of individuality there, huh?

And the No Fault divorce? This is another area of serious generalizations. They want to remove this option so people will pay for their infidelity. Of course, infidelity is not the only reason for divorce. But lets lump them all together. No need for individuality or individual liberties.

Yes, liberals are guilty of grouping people. But the social conservatives have lumped everyone into two groups. Its all Us v. Them. And the "Them" is always wrong.

Who the hell is "they"? Has more than ONE person on this thread suggested so? See? You're doing it right now.

The original poster plus CleverGirl makes two. Out of what, 10 people who posted here?

But two makes for a "they".
