I’m making no assumptions beyond what is presented in the video. My argument is against those who are making assumptions.
The only thing close to my being assumptive is that it’s her classroom so she has authority. Fact
Only person in the video wearing a hat is the one objecting. Fact
No mention in the video of any text on the hat. Fact
Based on those facts — and they are the only ones presented — the teacher is not in violation and the student is, in his being disruptive.
That’s all that is in the OP. The thread title mentions firing and lawsuit but nothing in the OP supports that.
There are people on this thread whom I hope never end up on a jury or justice will get screwed.

We cannot see the whole classroom so we don't know if he was the only one wearing a hat. We don't KNOW whether she actually asked him 'nicely' to remove the hat. You can see the text on the hat though not clearly what it was. Based on his 'Gulf of America" remark though, it's pretty safe to think it was a MAGA hat and the text you can see also supports that theory. So again, my personal opinion is that there is insufficient evidence to conclude what transpired before the short video clip. The teacher's authority is a prime concern yes, but if she violated all concepts of courtesy or reasonableness before what we see in the video, the student had a right to be offended and resist being 'singled out' if that in fact happened.

We don't know what happened before the short exchange we can see. I am just saying if she singled him out based on nothing more than being triggered by a MAGA hate, then she is in the wrong. If he violated a reasonable classroom rule that might be 'no hats' or political statement in the classroom, and that was clearly and politely explained to him, then he was in the wrong.

And this day and age, is knocking a person's hat off unlawful assault?

We have no way of knowing exactly what provoked the incident so we cannot make a judgment on either person's behavior without knowing that..
