I don't know what is going on in other states, but here in Virginia the courts have cosigned the actions because the legislature previously granted the governor extraordinary emergency powers to be used in his discretion and only the legislature can take that power back. Since Blackface has a dem majority, the efforts to reign those powers in have not gone anywhere. Those powers were granted in anticipation of a natural disaster however, and not a pandemic, so I expect that eventually the General Assembly will modify. Anyway, there have been several lawsuits. They all have failed so far as I know.

Are you referring to requirements the US govt places on workers, in the same manner as other employers place on their employees? OR are you referring to the use of health and safety regulatory power that apply to some private employees?
 
What everyone keeps calling a "federal mandate" really isn't. The federal government as an employer, lIke many others, is requiring all their employees to be vaccinated, and OSHA has issued a new standard for workplace safety, just like th one for hardhats in certain areas. No one has issued a federal mandate for everyone to be vaccinated.
Hard hats are removable and they are not injected into the body and one isn't stuck with the results of wearing one 24/7.

But just because the Constitution permits the government to require vaccines does not necessarily mean that the Labor Department may, as Biden says it will, issue a binding rule requiring large employers to encourage vaccination. The Labor Department may only act pursuant to an act of Congress. So unless Congress passes a new law, the department must rely on an existing statute if it wishes to regulate employers.

There is a strong argument, however, that the Occupational Safety and Health Act of 1970 (OSH) permits the Labor Department to act. Among other things, that law permits the secretary of labor to issue an “emergency temporary standard” regarding workplace health or safety if they determine that “employees are exposed to grave danger from exposure to substances or agents determined to be toxic or physically harmful,” and that such a standard is “necessary to protect employees from such danger.”

That was obvious in 2008 when Republicans bailed out Wall Street, the banking industry, the insurance industry, and the auto industry, and left working Americans twisting in the winds of foreclosure, and then cut off their unemployment benefits to force them back to work at slave wages.

I am not saying there should be no EOs. I am asking why a law like this was not debated and passed as legislation on the floor of Congress.

Executive actions rarely are. It's also irrelevant if a president is intent on doing it anyways.
