Courts do not like ETS orders and have a tendency to strike them down when presented the opportunity to do so. They did it when OSHA used an ETS to mandate respirators for asbestos workers saying the statute was too vague as to apply to asbestos cases because "grave danger" wasn't defined in the Rules to be able to show huffing asbestos dust presented a grave danger.

What everyone keeps calling a "federal mandate" really isn't. The federal government as an employer, lIke many others, is requiring all their employees to be vaccinated, and OSHA has issued a new standard for workplace safety, just like th one for hardhats in certain areas.
