It's disturbing that Beerman could be arguing for the federal courts to decide how states count votes. That is the opposite of federalism. But then some of us have been fearing the new Barrett Court would do just that. Throw out judicial restraint and conservatism for a new activist Court aimed at reaching "the right" result.

OR, he could just be saying that it would be good if states would devise voting procedures to get the job done quickly.

Roberts is bad enough but he at least has boundaries which he showed when he voted not to overturn the decision of the Pennsylvania Supreme Court. What is chilling is that 4 members of the Supreme Court would overturn a state decision. If Barrett is in that mode then we could have a judicial tyranny. At that point the Supreme Court should be expanded.
Republicans have confirmed 15 SCOTUS nominations to four for Democrats in spite of losing the popular vote in 6 of the last 7 POTUS elections. There's a good case to be made for corporate Republicans packing the Supreme Court over the last half-century and using litigation instead of legislation to shape the legal system to their ends.

The Ninth Circuit has authorized 29 judgeships, so perhaps SCOTUS should be tripled to 27. That way the Supreme Court could work year 'round with justices hearing each case decided by a lottery, so that anyone bringing a case before the court would have no way of knowing in advance which individual justices would make the ruling?

Kavanaugh has expressed sympathy to a legal theory that ballots should stop being counted on the stroke of midnight on election day..even though they were received on time.
