Garcia wasn't granted asylum after his case was heard in 2019.

Asylum was denied, but ordered that he could not be deported to El Salvador. The Trump Administration did not proceed to deport him to another country.

I’m not sure he got his hearing. (If he didn’t, he was entitled to it under our laws.) Also, the Admin, itself, acknowledged that a judge had previously granted the alien a measure of legal protection (also, it wasn’t confirmed that he was a gang member).

I’m curious about what happens if the “other” nation denies our request to send back to the U.S. A U.S. judge’s order to the Admin doesn’t bind a foreign land.

The Supreme court Justices are all lawyers...and ALL 9 said it was Constitutionally required to give them due process before deporting them, and from here on out, before deporting them, they have to give them due process...a way to defend themselves against the govt's accusations and further action....

Most of them would lose, but some of them....a few, or even just one or two, will prove the govt was mistaken, and wrong.

Due process- is one of the reasons America is Great, and was Great, and will forever be great.

Which sets up the Catch-22.

Plaintiff's must file a Writ of Habeas Corpus in the location where they are detained, which means the individual appears in court and gets to hear the charged and evidence against them.

But now the individuals are not in the country and can't appear before the Judge to plead their habeas case. Therefore Habeas Corpus is not an avenue open to them to attempt to right a wrong.

But also, Kavanaugh wrote, Make no mistake....all 9 justices agree...due process for those removed and deported, must be given first, from here on out.
 
They did not rule on the legality of using the Alien Enemies Act...not yet.
With all due respect they did. They stated what I have been saying for the last 2 months: NO JUDICIAL REVIEW IS ALLOWED
