Legality? It's already a law.
There is a very strong argument for using it.
The South American gangs are arguably militant organizations and TDA has strong ties to the Venezuelan government. I don't know what it is you're hoping for but it really confuses me to see somebody like you living in the United States working so diligently against national safety. Similar to the protesters the other day.... Out protesting but not really understanding what they were doing except for a lot of shouting and hating.
 
This deportation is over. Once the illegal alien leaves the country the only way to get them back is through foreign policy negotiations. The courts have no authority to demand anything in regards to direct foreign policy. The only thing the courts can do now is rule on future cases.
 
I'd like to know how, this clown is an ILLEGAL with no right to be in OUR country and is now back in his home country under their laws and leaders. Imagine if we demanded the UK send us one of their citizens.
He was legally in the country... A Judge ordered that....

He asked for asylum and he was granted it after he presented his case...

Why are you against due process and the rule of law...
 
I still think deportations without hearings is wrong, but I did not agree with the tonight at midnight timeline requirement either. The Supremes will do, what they are going to do, sooner or later, in this case, they will do whatever they are going to do Later.
Personally I think the SC has to ask for him to be brought back to US first...

This is about the power of the Judiciary and if the SC lets the Executive ignore Judge's orders then the system is basically an unlimited Monarchy. And you reap what you sow...

Every American should be wanting everyone to get due process. It is how everyone is protected...

Today they say they can do it to someone protected by the court... Where do you think this would end and don't think your guy will always be in charge..

ICE have claimed this was an administrative error... If that administrative error was to deport an US Citizen would you say the same thing?

ICE have to understand when a Judge says no, no it is...
 
He has an Order of Removal issued in 2019.

The only part is the Order said he should not be removed to El Salvador (where he is from). And that was owing to a claim he made of retaliation by a gang in El Salvador. (Which gang has since been destroyed by President Bukele).

That's it. The recent District Court order said bring to the USA, well an American embassy is the USA, so they could bring him to the American embassy in El Salvador and then deport him to a country of his choosing, or Argentina if he refuses to choose a country.

There is an order issued by a Judge not to have him deported...

He seemed Asylum in the US... Under Human rights law, US is where he can stay...

This is what the Judge knew as we'll...

It is against a number of agreement US has agreed on to force an Asylum Seeker to another country...

I don't see where he was running from MS-13. And the original hearing, the judge adjudicated him MS-13. This matter you posted was his request for asylum, which was denied, and relief under CAT, thus no removal to El Salvador only. A different issue.

You said the immigration judge adjudicated that he was a member of the MS-13 gang.

I provided the decision of the only immigration judge he's been before and the judge did no such thing.

Then deflect to a current filing from the DOJ which again provide no creditable evidence of being part of MS-13, merely unsubstantiated claims.

[DISCLAIMER: I have no problem with Garcia being deported to a country other than El Salvador - as the immigration judge ordered - as there was a removal order issued in 2019 that the Trump Administration didn't take action on. If he is a criminal? Charge him, send him to trial, convict him, send him to prison, then deport him. If he's not a criminal? He gets proper Due Process review and then deported.]

At a bond hearing, the immigration judge found that Abrego Garcia
presented a danger to his community and that he had failed to refute the
evidence that showed he was a verified member of MS-13. IJ Bond Order, ECF No. 11-1, at 2–3.
That evidence included that a “past, proven, and reliable source of information” had verified Abrego Garcia’s membership in MS-13, his rank, and his gang name. Id.

That not a ruling. It's the DOJ claiming what was in a ruling.

Now explain how he was released after the actual immigration hearing pending removal by the Trump Administration in 2019 to a country other than El Salvador, but they never did and he was freed from jail AND issued work authorization.
