Biden as we speak still hasn't declassified any of those documents.
But they're trying to say the statute of limitations (5 years) expired on all of the stuff he had.
The point should be (to those who have an open mind) that Biden and the DOJ have been caught once again being hypocrites exercising a two-tiered system of justice....and the fact remains....that the FBI never should have raided Trump's home in the first place.

There doesn't have to be any record....because any docs that Trump took with him were automatically declassified. This is a grey area in the law that only a POTUS falls under. 2) Only Trump is claiming he declassified them. His lawyers are not. They never made the case that he did. That is not the case they are trying to build. They have made no mention of this to a judge.
3) Even if Trump DID declassify them, that doesn’t somehow mean they belong to him. Declassified or not, it was illegal for him to take them as a private citizen.

~~~~~~No it just doesn’t matter because this kind of thing happens on occasion to different officials while in office. Biden had them when he was vice president. The problem is when the National Archive wants them back and the person with them refuses or when they no longer in office and take them to their private residence. That would be Trump.
