The only man to vote against the Unpatriot Act in the Senate was Russ Feingold, a Democrat.

You don't seem to understand how the judiciary works regarding 'when is SCOTUS going to declare it unconstitutional'. It's complicated, requiring big money to get a case to that level. The function of SCOTUS these days is to sustain the status quo, voting against individual rights and for corporations and government bureaucrats.
