They have to OK it. Trump cannot do it as an EO. He does not have the authority.
Perhaps you cannot grasp the concept---Congress has already funded the judgment fund. The DOJ already has legal authority to use the judgment fund to settle lawsuits/claims. It has been this way since 1956. Congress has not needed to approve any settlements since then. They are done solely at the discretion of the DOJ and Trump is their boss. If they want to stop him, they are going to have to restrict how the DOJ can use the funds i.e. amend the 1956 law.

Right now they are attempting to use the ICE reconciliation bill to attach amendments to deep six the judgment fund from being used for the $1.776B settlement and the $200+M for the East Wing ballroom. If the dems are successful in attaching the ballroom to the reconciliation vote, then it kills using reconciliation to fund ICE and 60 votes will be needed in the Senate.
