Trump loses Carroll case appeal

That's not a sentence.

If he had been sentenced Trump would have the option to appeal to a higher court.

The judge decided to forgo sentencing which thwarted any possibility of Trump appealing his conviction and having it thrown out.
You cannot give a jury the right to convict without evidence of the crime being presented in court. And no criminal court jury can convict anyone unless the vote is unanimous.

His due-process rights were abused in this case as well as a failure by the judge to allow exculpatory evidence to be presented during the trial.
Re: If he had been sentenced Trump would have the option to appeal to a higher court.

Since you're ignorant of the facts.

Trump's ongoing push to erase his criminal conviction lands in federal appeals court
UPDATED JUNE 11, 2025
NEW YORK — An appeal hearing for President Trump's criminal conviction and sentencing was held in a federal appeals court in Manhattan Wednesday morning.

But there is a law against claiming it as a tax deduction.
Then why didn't the IRS file charges against Trump for tax evasion?

I'll tell you why.

They knew it was a bull shit case.

Not to mention the fact that Trump isn't the one filing out his taxes.

If anything his accountant was the one who made the error....which is wasn't.

It was listed as a document error. Listed as a fine at best, not a felony.

They couldn't charge him with claiming it as a tax deduction....and thus they never pressed that in court.

I'll tell you why.
First let me tell you why you were wrong about Trumps status as a convicted felon.

His conviction made Trump the first president to also be a convicted felon.

Trump was sentenced ten days before being sworn in for his second term, receiving an unconditional discharge, meaning he will not face fines, prison or any other penalties, but the conviction will remain on his record. The judge in the case at the time explained that was the only lawful sentence that didn't encroach on the office of the president.

Let me remind you. The IRS doesn't prosecute, the DOJ prosecutes. And Trump picked William Barr head of the DOJ, who again and again, showed he was not willing to prosecute Trump for anything.

I'm not wrong.

I knew the conviction was on the record. But last reports said he couldn't even appeal a non-sentence. Until he finishes going thru the appeals process he cannot be called a felon, especially since he wasn't even sentenced. It's an absolute certainty that this travesty will be overturned on appeal.

Seems that judge slipped in this nonsense sentencing when nobody was paying attention. I didn't see or hear of it. The lame excuse that he couldn't sentence him because he was going to be president doesn't fly. Either he was guilty of a crime or not. Which is it?

Until Trump is sentenced to any fines or imprisonment technically he's not a felon.

Nope. He is a felon, the moment Judge announces the decision.

Just to point out. The IRS doesn't have say in State Tax laws.

But that is a side issue.

Falisifcation of business records in New York is a misdeomenor, normally.

However when that falisifcation is done to attempt to hide or aid in the crime of another, that becomes a felony.

Trump's laundering the payments to Cohen for his federal tax crime as attempting to hide the crime of another - a felony.

People say why would he do that. Which is a pretty good question. Cohen's crime was an illegal campaign contribution in the payment to Daniels. Why did Cohen commit that crime?

Candidates can make unlimited contributions to their own campaign, however those contributions still have to be reported to the FEC. Which means Trump personally paying the porn star would then become public record. So the scheme to launder the money through Cohen and then pay him back after the election.

There was even testimony at trial that Trump wanted to stiff Daniels (pun intended) by making the deal with payment after the election. Which undermines the idea that Trump paid the porn star to protect his reputation (ya, that's funny) or to keep Melania from learning about the affair (she already knew because the original story came out in 2011). If if the attempt was to stiff Daniels after the election, that shows it was not about reputation or Melania because if it was about either of those reasons then the timing of the election would have been irrelevant.

Nope. Taking into consideration what that judge allowed to take place....I wouldn't be proud of what happened, if I was you.

Ever heard of "miscarriage of justice"?

No....probably not.

You're just repeating the wording in the indictment.

The criminal conspiracy wasn't introduced as evidence in court.

Once again....there is no law that says you can't pay a porn star not to trash your reputation.

But according to Cohen....the payments were his idea.

Cohen decided to lie claiming falsely that Trump knew all about in court to keep from spending 20 years in prison.

Trump chose to sexually assault a woman in deep blue NYC
Nonsense; that was just her bullshit claim. Idiots buy it.
Trumps lawyers got a choice in selecting juror
No shit. But that’s hardly comforting given the venue. That’s the point, in fact. This wasn’t a real criminal case. It was first, last and always disgraceful political persecution. So, quite expectedly, they see his old stomping grounds in NYC to get that very jury pool.

Is our Justice system great or what?
It is. But, it is for GOOD reasons and not the shit you yammer about.

Apparently you're a legal idiot (or moron)
He was sentenced 10 days before taking office.
He is currently appealing his conviction in federal court on June 11th this year.

Everything you just said is WRONG

Until Trump is sentenced to any fines or imprisonment technically he's not a felon.
That statement is just STUPID.
Many felons are sentenced to probation. Or community service, or other sentences without imposing fines or imprisonment.

You're just being too stupid for your own good.

I'm describing the testimony at trial in front of the court.

The criminal conspiracy wasn't introduced as evidence in court.

Absoliutlley iit was via testimony by the co-conspirators. David Pecker (Newspaper Editor) and Michael Cohen (Trumps private attorney and the one that committed federal crimes for him).

Once again....there is no law that says you can't pay a porn star not to trash your reputation.

Correct. He was not charged with paying off a porn star.

He was charged with falsification of business records to hide Cohen election finance crimes.

It wasn't paying the porn star, it was the money laundering that got him in trouble.

But according to Cohen....the payments were his idea.

#1 You did pay attention to his testimony.

#2 Paying to kill stories was the idea discussed between Cohen, Pecker and Trump.

Cohen decided to lie claiming falsely that Trump knew all about in court to keep from spending 20 years in prison.

Except there were phone records, documents, texts, the testimony of others, etc. that coroborated Cohen's testimony.

Kind'a hard to lie with you have the documents to prove it and other confirm your testimony.

Cohen did not testify in a vacuum.

Probation is a sentence, dickhead.

Community service is a sentence, dickhead.

Trump never received a sentence.

15th post
NYC has known Trump his whole life
Nobody knows him better
Nonsense.

You spew a lot of absurd claims. You’re horrible at everything citing a legit source.

I lived in Buffalo for a few years. Yet I couldn’t name the former Mayor from those days. Living at a location doesn’t mean everybody knows you.

Until, and not before Trump gets his conviction overturned, he will remain a convicted felon.
Having a pending appeal, does NOT change the status of a criminal conviction.

Cohen lied about the conspiracy.

He was asked by investigators if he had anything on Trump before the trial and he said absolutely nothing.

They talked Cohen into lying on the stand.

They were unable to prove a criminal conspiracy ever took place. And because they weren't able to prove it, the judge gave the jury the option to vote to convict on the misdemeanors only.

Thus the only real conviction in this case was to 34 instances of document error.
