In a 7-2 decision SCOTUS has shut down certain abilities for Trump to deport people. Trump loses again. You see, people need to understand that just because Trump announces something, it doesn't mean he has done something.

I cannot help but be reminded that NOBODY stopped Biden from carrying out MORE deportations than Donald Trump. Biden followed the laws around due process, and his ICE carried out their raids without being lead by ICE Barbie swooping in on her private jet, for a photo op.

Biden was actually deporting people. Trump is just locking them up and abusing them at taxpayers' expense, while the courts demand that he follow the laws. This is no different than last time.

Splitting up families, grabbing people off the street. Now they're going into primary schools to terrorize immigrant children.

Shame, shame on these criminals. They should be prosecuted for child abuse. And for all of this hysteria and abuse, and blowing through the entire ICE budget in less than 5 months, Trump is still deporting fewer people than either Biden or Obama did, while staying within budget.

What the fascist right fails to understand is that no one objects to the lawful, warranted removal of immigrants who are criminals and gangsters, or who are otherwise in violation of the law.

But immigrants accused of violating the law must be afforded their comprehensive right to due process whether alleged gang member or asylum seeker.

The thread isn't about civil due process and the removal of illegal aliens under normal rules.

It's about Trump's use of the 1798 Aliens enemies act which requires an Act of War (declared by Congress) or an invasion by a foreign nation or government. And the resulting lack of due process for those identified to:

A. Challenge the application of the AEA as unlawful as the conditions which provide the President certain extraordinary powers have not been met (i.e. declared war or invasion by a foreign nation).

B. To challenge whether they - as an individual - are within the group identified within the President's Proclamation.


It appears some people can't wrap there head around they fact that normal deportation as one thing, sending people with no due process to a 3rd world country human storage facility with no communication, not access to family, no access to counsel, and no access to the courts for imprisonment without court reviewed evidence and the ability to challenge that evidence are two different things.

The case was not lost. It was sent back down to the Circuit Court.

It does seem clear that the SCOTUS s operating on the belief that the “due process” right to be heard (including an implication of a right to review immigration lower Article III court decisions) applies to even illegal aliens.

The ultimate question is likely to eventuallly become: what “process” does an illegal alien have a “right” to?

The answer to that question may displease both sides.

If Trump was to defy the SCOTUS then we would have the constitutional crisis people have been warning of.
The SCOTUS' role (as specified in the constitution) is to serve as a coequal check and balance on rhe President.
If the POTUS refuses to accept or aknowledge SCOTUS' role in checking and balancing his power then he will be basically wiping his ass with the very constitution he swore he would uphold and defend.
At that point, after he has violated his oath of office he would need to be impeached.
That would be up to Congress, the other coequal check and balance on his aurhority.
