This is where people are confused. The presidents power is in declassifying "information" not documents.

As I pointed out, the president can't have two identical documents on his desk, and he declassifies the one on the right, while the one on the left remains classified.

It doesn't work that way.

Which is why a president can't just declassify a documents, because the intelligence agencies have to know what information was in the declassified documents, and declassify that information in other documents as well.

Who what and where others receive the information that something is declassified is a different topic. The fact is the President has the power to declassify simply by saying it. Democrats deliberately confuse the issue for political reasons, as usual.

If the FPOTUS felt that certain documents contained information of evidentiary value, then the PRA of 1978 provides that the FPOTUS or his designated representative has access to NARA storage facilities to review such documents and for non-classified Presidential Records the NARA can provide copies as needed.

Some people just need to learn to read their own links.

The FPOTUS term ended at noon on January 20, 2021. At that point the records remained the property of the United State government and were to be turned over to the NARA because they became their responsibility and the law says they were to have custody and control.

In American law, there is a such thing known as "criminal intent". An accuser bears the burden of proving criminal intent. In this case, that appears to be impossible.
