Actually evidence is presented by the plaintiff to support the initial summons.
More evidence is presented in response to the defendents answer.
If there is a motion to dismiss, more evidence is presented to support the plaintiffs position.

There is usually a mountain of evidence given to the judge before the parties even go in front of the judge.

How does it feel to want. When evidence is submitted that meets the legal standard and a judge allows it to be brought forward then there can be a trial and it will be televised if the judge allows it.
