Today's the Day: Birthright Citizenship

Court says they are not deciding whether birthright citizenship is constitutional

Barrett, writing the main opinion:

"federal courts do not exercise general oversight of the Executive Branch; they resolve cases and controversies consistent with the authority Congress has given them. When a court concludes that the Executive Branch has acted unlawfully, the answer is not for the court to exceed its power, too."

Thomas, in the concurring opinion:

First, Thomas has a concurring opinion in which he stresses that the Court "today puts an end to the 'increasingly common' practice of federal courts issuing universal injunctions."

ACB is apparently BLISTERING Jackson right now, saying she decries an imperial presidency but embraces an imperial judiciary

OUCH

It was much more consequential than the birthright issue.

The District courts have just been neutered, rightly so.
Interesting. I shall read it. In the interim from The Hill:
For now, the justices narrowed the lower court rulings to only block Trump’s order as applied to the 22 Democratic-led states, expectant mothers and immigration organizations that are suing.

The Trump administration can now resume developing guidance to implement the order, though it must wait 30 days before attempting to deny citizenship to anyone.

However, the majority left the door open for plaintiffs to still try to seek broad relief by filing class action lawsuits.

SCOTUS will make their decision today, which ends the term. IMO if SCOTUS doesn't smack it down, then the deportations should increase. We simply cannot afford all these services for children of illegals.

They ruled that some states can allow it and other states can ban it.

That means if you are born in CA your citizenship doesn't apply in TX or TN.

While I have not read the full opinion (its a mere 110 pages) it appears reasonable. It limits to the states, and parties involved, but leaves open class action etc. as its an action in equity.
People thought it would be a ruling of whether the Constitution is constitutional, and whether birthright citizenship, was as stated in the Constitution, but instead it ruled on whether individual judges across the country can single-handedly block a president. It is probably more damaging to the rule of law, in the long run, than the decision on powers of individual judges.

States were a decision doesn't apply can still be bound by subsequent legal action.

I'm sure everything is still up to some ridiculous legal bull shit in the future.

But the fact remains.....all of this is due to the dishonesty by the left.
None of this would be necessary if that fact was otherwise.

The 14th Amendment was about former slave's children....not invading illegals.

EOs are lazy leadership. Trump doesn't want to build consensus for his policies or persuade Congress to pass laws. He just wants to issue edicts. That's bad government.

Yes. This decision will help Trump cut spending and prevents corrupt judges from getting in his way.

This isn't the end of the abuse and overreach by activist judges, but this is a kick in the nuts for people who make a living screwing up America.

Agreed, but those district judges do need a smackdown.

Katanji-Brown Jackson can only stand so much bad news in a day. The USSC will wait I think until October to issue a decision on the constitutionality of birthright citizenship, but the early indications are that Jackson and the Lefties are not gonna like it.
