No she was not above the law, and I think most people would agree that she should have just complied instead of trying to flee. Her fleeing is not reason for her to be executed though.

Striking a law enforcement with her vehicle was however grounds for lawful lethal response from the law enforcement officer.

How sure are you that Mr. Gomez-Guerroro would not have backed up and finished the job, if Officer Vilafuerte had done the matador move you are so sure you would have done in the same situation instead of defending himself with his firearm?
He was slowly pushing his car forward. Like I said about the 2nd video, that was a clear justified use of force. What reason do you have to believe that Gomez-Guerroro would have backed up his card and 'finished the job'. Do you think, from that video, that Gomez-Guerroro was actually trying to kill the officer? Is that you think?
 
You want people to abdicate freedom.

Making this crazy ***** who never worked a day in her life and abandoned her children to play amateur Brownshirt with her wife into some kind of anti-ICE martyr will not force Trump and Noem to give up their efforts to enforce the laws that the Autopen administration actively violated for four years.

2K more ICE agents are on their way. They had to be hired very quickly, due to the immigration disaster that Biden created, and I doubt that crowd control took up too much of that limited training time.

So, when they are attaced with deadly force, they will go the simplest defense, which is their issued firearm. Since all the members of this board can at least read and write, I'm sure you are smart enough to know not to go there and start harassing LEO's. But you might tell Cousin Pookie, Cousin Sylvia, or Cousin Cletus that Minneapolis is not a good place for them to go and act a foll.

Do you think that she intentionally and deliberately was trying to hit the officer with her vehicle? Out of the following choices what do you think her primary goal was:

a. Leave the area to avoid the officers trying to get her out her car.
b. Strike down the officer that put themselves in front of her car?
c. Escape the immediate officers, and then turn her car around and try and run them down in her car

In 2022, when the DOJ updated their policy (this gets updated EXTREMELY rarely btw, the last update to it was in 2004), it included an update to the policy of 'Moving out the way of vehicles'.

"Firearms may not be discharged solely to disable moving vehicles. Specifically, firearms may not be discharged at a moving vehicle unless: (1) a person in the vehicle is threatening the officer or another person with deadly force by means other than the vehicle; or (2) the vehicle is operated in a manner that threatens to cause death or serious physical injury to the officer or others, and no other objectively reasonable means of defense appear to exist, which includes moving out of the path of the vehicle. Firearms may not be discharged from a moving vehicle except in exigent circumstances. In these situations, an officer must have an articulable reason for this use of deadly force."

Alongside this, the Biden Executive Order 14074 (May 25, 2022), means that this DOJ update applies to all federal law enforcemnt agencies. Whether this was actually implemented by ICE is the question (The DHS has recently redacted the Use of Force policy -- how's that for transparency?). But I think this policy of moving out the way (when the driver has not given justifiable reason for the officer to believe that the person is a threat to other people if they are allowed to continue driving) is a good one.

And in terms of police departments around the US, any that don't yet have this policy, should enact it. I don't think there is any reason not to. Do you agree?

This isnt accurate though. The every day experience of law abiding versus those that are negative is vastly different.

Negative law enforcement encounters are almost always, not always, the result of disrespectful interaction by the citizen.
Citizens have the right to be disrespectful of cops.

We all know that cops will treat us poorly if we exercise protected speech. This is an admission that they’ve intimidated us into silence and that we don’t actually have free speech.

Here's some bad news for the right:

Reasonable people who watch this video will cringe at the fact the officer discharged their weapon.

Reasonable people will be disgusted at the fact that there are illegal immigrants being caught up in ICE's crackdown that were bought to this country as a young child. Imagine this, imagine being bought to this country as a 4 year old, or as a 5 year old, through no fault of your own. All you've ever known is America as far as your memories go. You might not even know the language of the country that ICE is trying to deport you to. You grow up in the US, all your memories, relationships, friendships, culture is American. And then ICE takes you and is trying to deport you to a country you don't know.

Why don't you take this video and go to some forums that are European based, and post the video, and ask them what they think of it? If it's as reasonable as you say it is. You must be shocked to find that many European countries navigate law enforcement without even being armed with a gun. But you snowflakes are too scared to move out the way of a car that is fleeing and not even intentionally trying to hit someone.

ICE is not under the DOJ, Redrick.

Even if it were, this sentence:

(2) the vehicle is operated in a manner that threatens to cause death or serious physical injury to the officer or others,

is exactly what happened and forced the ICE Officer to defend himself.

IF that is accurate...it's yet more evidence that he shot her out of anger, not because he genuinely believed she was a threat to his life.

As for all those saying she should have obeyed orders and gotten out of the car in the first place... I'm not condoning what she did. Maybe because she was familiar with their track record of excessive force, she didn't want to get beaten or pepper sprayed or worse. :dunno: But even if her decision to flee was a bad one, fleeing alone is not a capital crime.
Makes him look more and more guilty. Too many officers are bigots. That is no.part of a good officers makeup.
