It's not a personal passbook savings we're talking about. When you read the Federalist Papers, and the original intent of the Founders, the best way to look at the Bill of Rights as if it was the Ten Commandments. Thou Shall Not. Thou Shall Not abridge Freedom of Speech. Freedom of Press. Freedom to Assemble. Thou shall not.
However since the Founders died, the nation has taken the Constitution as a hurdle. An Obstruction. It is something to get around, over, or bypass. We find loopholes. We have forgotten the Thou Shall Not. And we have watered down those rights that the Founders believed to be absolutely unassailable.
Thou Shall not. Those words should be included. And in a way they are. The First Amendment does not say. The Supreme Court shall rule as invalid any law passed by Congress, and signed by the President, or in the case of a Veto, confirmed by a two thirds majority which abridges Freedom of Speech.
It says Congress shall pass no law. Thou Shall Not.
The Fourth Amendment is one we have spent a long time finding exceptions to. Ways around that pesky restriction. Until there are more exceptions than restrictions. I have always thought that was wrong.
Whenever the Police arrive and ask for information, the answer should always be, do you have a warrant? Even if it is information on one of your customers. Or information on a job you did. Do you have a warrant? Where the hell is it?
But we have found loopholes. Now, the Banks can’t say do you have a warrant? They are prohibited from protecting that information, thanks to the Supreme Court who decided that you had no expectation of privacy. We have utterly lost the entire purpose behind the bill of rights. Now, they are considered arcane and irrelevant. Because for centuries we have spent our time trying to figure out a clever argument to get around them.
That is the problem. Not the FBI getting the information on some RW types. Nor the FBI getting information on LW types. The fact that they can get the information at all without a warrant is the problem.
For a long time now I have spoken out against this. I spoke out against Carnivore, Stingray, FISA, Black Bag Jobs, and the rest of the abuses. But we as a people have not spoken out. Now, the people who cheered these actions, to get the guilty, are being targeted. And it is too late to push back. It is too late to reestablish those rights the way they were intended. It will never be Thou Shall Not ever again.
