Supreme Court Justice Kagen: Our Rulings Must Follow Public Sentiments

Actually, creating a constitutional right that doesn't exist in the constitution, abortion, was done by corrupt judges packed by the radical left. If then, as you say, the judges on the right just nullified the nonexistent fabricated constitutional right, they simply brought the facts back in line with the constitution. It is the right of the people to push for a constitutional convention to propose an amendment to the constitution, but not to legislate from the bench as Kagen has advocated.

Your comment might have had some validity IF the Roe v Wade decision had been the decision of a liberal court. The Decision was rendered by a majority conservative court and was a bipartisan decision. The majority opinion was written by a Republican appointed Justice, and had been upheld numerous times over the years by both conservative and liberal courts.

This current iteration of the Supreme Court is a rogue court, packed with radically right wing judges, financed, groomed, supported by dark money interests in the Federalist Society, to overturn Roe, and other liberal legislation and/or laws, and to ensure a white radical christian oversight of the federal governent.

The Court lost all credibility when Mitch McConnell stole Merrick Garland's appointment, and rammed through a minority appointment of ACB, the least qualified and religiously radical of the bunch of them.

You still haven't addressed the fact that the "constitutional right" was created by a court instead of the constitution, while you try to deflect the facts by arguing the make up of the court. The fact remains the right doesn't exist in the constitution and if you want to add it you should push for a constitutional convention. Your argument of blaming the right for appointing unqualified justices loses all merit when you consider the latest appointment by Biden. While Kagen ws an unqualified maverick appointed because of her sex and left wing ideas, the latest appointment was simply based on race and sex. The court is supposed to uphold the law, not legislate whatever new ideas the left or right have.

Overturning all decisions the radical right don't like because the Federalist Society has packaged and packed the SC with corrupt judges from the right, has nothing to do with the Constituition.

Dark money is undermining the Constitution and the freedoms and privacy provision it contains therein, to ensure an evangelical Christian governance of the country. This is a generational product of the Christian right that started with Liberty University.
“Dark money is undermining the Constitution”

Say hi to foreigner George Soros, Kanuck!

She should be impeached and removed from the court.

She is 100% right. John Roberts has said something similar which is why he was trying to salvage Roe vs Wade. If the court becomes a creature of politics which it clearly has become, then their rulings will be ignored.

She obviously believes emotion and ipinion means more than the Constitution.

The Constitution says nothing about judicial review. The Supreme Court's authority is not enumerated. The Constitution states that rights do not have to be enumerated for them to be rights. In addition, the Supreme Court has thrown out parts of the Voting Rights Act even though the Constitution specifically gives Congress the power to regulate federal elections.

No it was not. Roe vs Wade is a conservative ruling. It states that government cannot dictate to a woman what she will do with her body.

George Soros isn't bankrolling radical right wing Supreme Court Judges to turn the USA into a theocracy. Nobody knows who is behind the Federalist Society funding, grooming, and promoting placement of their picks on the Supreme Court, but the rogue court is now ruling in favour of radical right wing religious organizations making SC challenges to on the basis of religion, the majority of the time (58%). Past courts ruled in favour of such churches about 15% of the time.

Soros is publically making donations to leftist causes to help make a difference, and not trying to control the organizations once he donates. This isn't "Dark Money" - money donated by anonymous sources with questionable motive, these donations are made strings free, out in the light.

Roe v Wade was decided by a Conservative Court, and the Decision was authored by a Republican justice.

Abortion was NEVER a partisan issue until Reagan Republicans adopted an anti-abortion stance to get votes from Catholics and Evangelicals.

Biden and Democrats are trying to step in and dictate what the states can and can not doing regards to rhe legislative control THEY - not the Federal government - have just been given by the USSC.

The USSC just told the federal government, 'YOU no longer have the power to legislate / dictate the legislation of / regarding abortions down to the states. THEY now control their OWN legislative decision making regarding abortions!'

Your lies are just as bad as Brandon’s.

Court rulings must follow the constitution and established legal precedent, not public sentiment or opinion.

Most rights are not spedifically written in the constitution.

Unlike Alito, who’s rulings follow religious doctrine

SPIN! SPIN! SPIN! The title of this thread is a blatant lie. She said NOTHING of the kind.

What the Justice REALLY said:

“I’m not talking about any particular decision or even any particular series of decisions, but if over time the court loses all connection with the public and with public sentiment, that’s a dangerous thing for a democracy,” Kagan said at a judicial conference in Montana.

And she is absolutely correct.
That says what the OP says. Mob rule. She's not correct; she's wrong. The court decides based on the Constitution and it's up to the Congress and the States to change the Constitution if that's what public sentiment demands and if that's what the Congress chooses to do.

Most rights are not spedifically written in the constitution.
And any protection or legislation on those rights fall to the States or, if the State Constitution says differently, to the People. Read the 10th Amendment.
