This is a statement prepared and released by a working group of former JAGs.

JAG = Judge Advocate General, from the legal branch of the U.S. military,

They reach a simple but damning conclusion:

"The Former JAGs Working Group unanimously considers both the giving and the execution of these orders, if true, to constitute war crimes, murder, or both."

reports are true, the two survivors of the 2 September 2025 U.S. attack against a vessel
carrying 11 persons were rendered unable to continue their mission when U.S. military
forces significantly damaged the vessel carrying them. Under such circumstances, not
only does international law prohibit targeting these survivors, but it also requires the
attacking force to protect, rescue, and, if applicable, treat them as prisoners of war.
Violations of these obligations are war crimes, murder, or both. There are no other

That's International Humanitarian Law from the second Geneva convention in 1949.

Key principles of IHL regarding survivors at sea:
Protected Status: Shipwrecked, wounded, and sick persons (whether enemy combatants or civilians) are considered protected persons under the Second Geneva Convention of 1949 (GC II) and customary international law. They may not be targeted, murdered, or ill-treated.

Duty to Rescue and Care: After an engagement, the attacking force is legally obliged to take all possible measures, without delay, to search for, collect, and care for the shipwrecked and wounded, as military circumstances permit. They must be provided with adequate medical care and attention based on their condition.

Prohibition of "No Quarter": Orders to give "no quarter" (meaning to kill everyone and take no prisoners) are explicitly forbidden under the 1907 Hague Convention IV and are considered a grave breach of the laws of war.

Individual Accountability: Commanders who issue orders to kill survivors, and individuals who carry out such "patently illegal orders," can be prosecuted for war crimes, murder, or both. Military personnel have a duty to disobey orders that are manifestly unlawful.
