Today Sonia Sotomayors confirmation hearings started with a quick jab from a few republicans. Sen. Lindsey Graham said just feel unnerved by your speeches," commenting about her statements about the wise Latina could reach a better conclusion then a white male.
Lets play what if. What if, Lindsey Graham said that based on his life experiences he could make a better conclusion as a White male then a Latina women. What if, he just said a better conclusion then a women Senator. Not only would the news media try to hang him on his words, but the women groups would be all over him and demand that he step down as Senator. Am I wrong?
Judge Sotomayor has said:
- I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life.
-Personal experiences affect the facts that judges choose to see.
-This wealth of experiences, personal and professional, have helped me appreciate the variety of perspectives that present themselves in every case that I hear.
What about the cases were Judge Sotomayor ruled over the New Haven Firefighters? Frank Ricci a dyslexic white American man with Italian decent was passed over for a promotion because not one black candidate tested well enough to qualify. Judge Sotomayor didnt think there was enough evidence to over turn the case. Once this case made it to the Supreme Court they ruled in favor of the firefighters and said there was plenty of evidence. Sotomayor used case law to rule and let the case slide up to the Supreme Court. So why couldnt Sotomayor make the hard decision when the case was in front of her court?
[ame=http://www.youtube.com/watch?v=zsDy357yFKY]YouTube - Obama on empathy and the Supreme Court[/ame]
Obama said that he would choose a nominee for the Supreme Court who would employ empathy, an essential ingredient for arriving at just decisions and outcomes. Empathy as per my Webster Dictionary says (ability to share in anothers emotions, thoughts, or feelings.)
Correct me if Im wrong people, but I though Justice was blind. We need Judges that are like base ball referees. They go out on the field and let the players play. They enforce the rules and thats it. We dont need politicians in the Supreme Court! We need someone that will represent all of us black, brown, white, red, and yellow. We need a Judge that wont see color. A Judge that will make the hard ruling not because they feel emotionally attached to someone but because its the law and that their ruling is supported by our U.S. Constitution. Is that really to much to expect for a position that is given for a life time?
