It will take a law to transfer any functions they keep to another department, like HEW where it came from. No executive order can change a law, despite all of Biden's efforts to do just that. The President is obligated to preserve, protect and defend the Constitution.

So, he can unquestionably make a determination that the Dept of Education itself is unconstitutional.

It’s absurd to believe that the libs and Democratics would just roll over. So, there is zero doubt that it would end up in court.

There, the new AG would be the one required to defend the President’s action.

The case would swiftly end up in the SCOTUS.

Don't just wipe it out.....transition it to the states so that what's left is a one floor of some obscure government building.
