There, the new AG would be the one required to defend the President’s action.

The case would swiftly end up in the SCOTUS.

NONE of what you posted is remotely true. In fact, the Solicitor General argues cases before SCOTUS. The one thing you did get close on is that such action would wind up before SCOTUS where it would be laughed out of court 9-0.

l have been teaching for 30 years and, other than dole out some Title 1 money, I have no idea what they do. None whatsoever.

Again, while I agree that it may be beneficial to phase out the elimination of the federal DEPT OF EDUCATION, it cannot be done in such tiny steps as to basically just give it a close shave and a haircut.

The solicitor general isn’t the AG. Arguing the case before the SCOTUS is not the point and never was. (And, by the way, you self important asshole, you’re also wrong. An AG is certainly allowed to grant himself the task of making the oral arguments to the SCOTUS. RFK did it as AG, for instance.)

And the SCOTUS would almost certainly permit the President to eliminate the Dept of Education since it clearly does not comport with the Constitution.

There is not a single solitary grant of any enumerated power given to the federal government over “Education.”

This latest Trump selection seems pretty strange — until one realizes

that the U.S. Department of “Education” won’t be around very long once Trump is inaugurated.
If the qualifications of Trump's other nominees are indicative, his Secretary of Education probably didn't graduate kindergarten.

In purely historical terms, when the quagmire that is the DC establishment can’t manage to act, Trump has other tools and powers to accomplish his goals.

The briefs filed for the United States are under the name of the AG.

And an AG is the boss of the Solicitor General. So if the AG were to direct the Solicitor General to stand aside so that the AG could make the arguments to SCORUS (for oral arguments), the AG could legally do so.

It doesn’t matter though. Personally, I wouldn’t want Gaetz to handle the oral arguments. That’s not even what I was addressing. But instead, again, it is the AG and his DOJ who would perform the duties involved in sustaining the move by Trump to scuttle the Dept of Education.
