The idea that police can search your smartphone was already decided by the California Supreme Court in People v Diaz. The US Supreme Court declined the case.

Now, let me go on record as saying that I don't support this notion that simply by being arrested (for jaywalking or whatever) that the contents of my iPhone should be subject to search without a warrant...I don't, but what would have happened to legislation that basically overrides a State Supreme court ruling?

I used to say that someone would have to double my salary and offer plenty of other perks to get me to move to CA.

Now, I can't imagine anything that I would accept.

when I worked for my old corp. master, the co. had to provide a 12% pay bump for area cost of living here in santa clara cty.

When they cut that to 8%, they could not get anyone to come here except under a silkily and probably illegal gesture ala 'termination if you don't transfer here' from other out of state plants.

It became a real issue and they moved it back up to 12% and even then, no one was knocking the door down even if their job was downsized in another state, they rather take their chances there as a layoff then come here for a for sure job. it didn't mater in the long run as the co. has moved 90% of its manuf. and R&D out of state now anyway, about 5K very good jobs went with it not incl. all of the contractual services etc. we employed on a day to day basis. .

add to that when ever we got stock, I paid an extra 10.23% of cali state tax for shares that in other states ala oregon etc. where in the same co. employees didn't.

if they sat down and debated how to willfully chase biz. and folks out of the sate they probably could not do a better job than they are right now.

when I cam here many many years ago, it was a place where in still, you could 'start fresh' and be left the fu*k alone, now? well, here we are.
 
Oh California. What happened? They've become a fallen giant for sure. Their glory days are definitely over for good. Brown also banned tanning for some Californians this week. That move is likely going to cause quite a few small businesses to fold. More unemployed. Just what California needs. I keep telling people that Socialists/Progressives do not care about freedom & liberty or the Constitution. This is just more proof. Brown is already a disaster out there. Unfortunately things are going to get even worse for Californians. It's very sad.

You can't search a landline for texts, your email, your web history, or even the pictures you took. One has nothing to do with the other.

There is too much information for the cops to be allowed to go fishing. I would argue that a cell phone is a separate enclosed space that needs a warrant.

There is too much unrelated stuff in there.

Of course, if they find a wad of coke in your car, that might be enough to allow them to go before a judge and get the warrant to get the address of your coke dealer off the phone. But they need to convince the judge of that.

Just flipping through the phone on spec is not a good idea.

The cops already pretty much have the right to search your car for whatever if they see a tail light loose.

The legislation becomes the law, police have to follow it. The only way the court ruling becomes the rule again is if the court rules the law violates the constitution. For that to happen someone would have to show harm in order to have standing, and that ain't going to happen.
