The first person arresed on evidence obtained from a warrant-less phone search should run right to an appeals court. I can't see even the 9th circuit letting this shit stand.

That move is likely going to cause quite a few small businesses to fold. More unemployed. Just what California needs. The idea that police can search your smartphone was already decided by the California Supreme Court in People v Diaz. The US Supreme Court declined the case.
Now, let me go on record as saying that I don't support this notion that simply by being arrested (for jaywalking or whatever) that the contents of my iPhone should be subject to search without a warrant...I don't, but what would have happened to legislation that basically overrides a State Supreme court ruling?
