However the land that was granted for DC came from Maryland and Virginia however Virginia was given it's land back so now you just have Maryland and I doubt they'll have a problem with a 51st (or 52nd) state, nor would Virginia.

I think the challenges would be legal, having to write the bill to make the new state around the 23rd amendment, not impossible but there would be legal challenges and most likely this would end up in the Supreme Court. They're a little bit of an unknown as to how they would react.

The larger hurdle is the senate as it would require the Democrats to win a majority and then kill the filibuster. I could see a couple of the Democrats not going along with this as it could potentially endanger their own powers playing spoiler to a Democratic majority. (Sinema, Manchin)

The District of Columbia would still need to exist however the size and location are not coded into the 23rd amendment. My understanding is that it's just required that DC have the same number of electoral votes as the smallest state. So, you simply just for lack of a better saying redistrict the district. So that DC only takes up the federal buildings and the mall. The rest of DC would make up the new state. Then we would have the new state with a full set of representatives, senators and electoral college votes (probably still 3, maybe 4). DC and what's left of it would still retain it's 3 electoral college votes and at this time pretty much the only citizens of DC would be the president and his/her family and maybe some staff. It's at this point that it might be pretty easy to amend the Constitution to strip the electoral college votes from the smaller District of Columbia.

Democrats if/when it's possible should take this route. Fix the issue with lack of representation for the citizens of DC and then solve the constitutional issues that will be crated afterward.

My understanding is that it's just required that DC have the same number of electoral votes as the smallest state. So, you simply just for lack of a better saying redistrict the district. So that DC only takes up the federal buildings and the mall. The rest of DC would make up the new state. Then we would have the new state with a full set of representatives, senators and electoral college votes (probably still 3, maybe 4). DC and what's left of it would still retain it's 3 electoral college votes and at this time pretty much the only citizens of DC would be the president and his/her family and maybe some staff. It's at this point that it might be pretty easy to amend the Constitution to strip the electoral college votes from the smaller District of Columbia.

Democrats if/when it's possible should take this route. Fix the issue with lack of representation for the citizens of DC and then solve the constitutional issues that will be crated afterward.

I said might be. Considering that after everything else in my post happened almost nobody would actually live in DC so at that point stripping away it's electoral college votes should make sense to everyone.

You fold the existing territories into the existing states. DC goes to VA/MD. Puerto Rico becomes part of Florida as does the VI. Guam becomes part of Hawaii along with Midway and Wake (I think those are our territories out there). No new stars on the flag. They get represented by the same representatives they have now pending the census reallocation. The 3 electoral votes for DC disappear (it makes no sense to have an even number of electors).

Easy. Logical. Adult.

For all 3 reasons it will never happen.
