It would only be a "legal precident" if State law barred Lincoln from appearing on the ballots or if the Republican Party in those states choose to not place him on the ballot. One is an action of the State government, the other is the action of a private organization.

Huh? I'm no birther, but dude, the point of the State law is proving he does meet "the Constitutional requirements for the Office of President." You're stating that as assumption, it's referred to as "begging the question."

I have no sympathy for anyone who's trying to get him ousted as President, but I have no issue with States demanding candidates meet Constitutional requirements to be President to be on their ballot for President. But Obama met whatever rules were in place when he ran the first time so unless the birthers can prove he wasn't born in the US they need to shut up about that and move on. As far as evidence, there are currently only 3 people on the planet who claim they were present for Obama's birth, his grandmother and two half siblings, and they all say he was born in Kenya.

He may be a citizen but he's still not qualified to run for President if he was born in Kenya. Under the law, you must be a natural born citizen to qualify to be president. To be born outside the country and still be considered natural born, your mother must have been at least 23 years old at the time of birth, and Obama's mother was only 18 when he was born.
