There was another video from the other side which shows that he had to jump out of the way. The camera footage from his vest also indiciates contact. Regardless, she didn't have to hit him for it to be considered an assault on an officer.

The agent was looking right at her as she frantically turned the steering wheel sharply away from him. He even video recorded it himself.
