I read what started Kelly whining again.This is a military decision made under the U(niform) C(ode of) M(ilitary) J(ustice).
Different rules apply and Kelly just stumbled-over the UCMJ trip-wire.
I'm not even sure that civilian courts have much "say" in the matter.
My own first guess?
1. his reduction-in-rank and pay-reduction stand
2. he gets reinstated and he gets backpay once the Democrats are running the DoD again
Even the DoD (DoW) has "administrative orders" that can be reversed.
Unless, of course, they call him back to Active Duty status long enough to court-martial him.
That, in turn, might lead to a Dishonorable Discharge and a long vacation in Leavenworth.
Reversing a court-martial might prove just a wee bit more of a challenge.![]()
