Every president since Reagan has used delegated tariff powers — the difference is that Trump used them on a much larger scale. The $4 trillion figure is misleading; tariff revenues never came close to that, it refers to the value of goods covered. And while lower courts have recently ruled some of Trump’s tariffs unlawful under IEEPA, the Supreme Court will have the final say this fall. Until now, presidents have been given broad discretion on tariffs, and Trump simply pushed that authority further than anyone else.
