1 Yes it should pass
2 No it shouldn't
3 If the molester knows he'll get the death penalty, he is more likely to murder the child (= destroy evidence)

But on the other hand, if someone knows he will be put to death for molesting the child, well, that alone should deter him..

so maybe I need not worry
