Who would stay? Well, if you are close to retirement, and many of those who took the buyout are, then it’s an easy decision. If you work in a field that is highly marketable, you might just say fuck this and leave. If you are a scientist, and you are going to be forced to promote political ideology in lieu science, then that might be enough reason as well. A lot though, were close to retirement and they could afford to take the risk of accepting a very risky offer that might not pay.

Ultimately Congress has control. It will require an act of Congress to reacquire powers they already delegated away, if that's what they want to do.

The courts may NOT decide who has control over the money. Such a ruling is invalid on its face, and the Supreme Court will undoubtedly agree BECAUSE THEY MUST. Because they are required to adhere to the Constitution.
