Let me summarize the high points of the story. First. Guns that were sold in America to Straw Purchasers ended up in Mexico in the hands of the Cartels.

The gun sellers tried to invoke the Protection of Lawful Commerce Act. This law protects gun makers and sellers unless their actions are negligent or otherwise illegal.

The judge did throw out some of the claims by the Mexican Government. Other claims appeared valid and outside the scope of the protections of the PLCAA.

I don’t believe a trial date is set. This case seems to be an interesting one.

Fast & Furious amnesia hits Attorney General Eric Holder during House testimony

Mexico is suing the wrong people.

If you bleev the wiki on this highly charged topic? It seems small. I'm willing to bet, it is much larger in scale, as no one answered any questions on it officially.

". . . Each weapon was equipped with a GPS unit initially installed by El Paso Intelligence Center (EPIC), later purchased at a local electronics shop by the ATF. Critically, the GPS battery life was only a few days and the GPS weapon "tracker" signal was routinely lost especially in car trunks.[8] This lack of technical sophistication and failure of GPS as a tracker, were the major reasons for Fast and Furious failure as an ATF operation.

The stated goal of allowing these purchases was to continue to track the firearms as they were transferred to higher-level traffickers and key figures in Mexican cartels, with the expectation that this would lead to their arrests and the dismantling of the cartels.[6][9][10] While federal prosecutor Emory Hurley allegedly told agents they had no choice but to let guns "walk" because agents lacked probable cause to arrest buyers, the tactic of allowing obvious straw purchasers to give guns to criminal organizations was questioned during the operations by ATF field agents and cooperating licensed gun dealers.[11][12][13][14][15] During Operation Fast and Furious, the largest gunwalking probe, the ATF monitored the sale of about 2,000[1]: 203 [16] firearms, of which only 710 were recovered as of February 2012.[1]: 203  A number of straw purchasers have been arrested and indicted; however, as of October 2011, none of the targeted high-level cartel figures had been arrested.[6]

Guns tracked by the ATF have been found at crime scenes on both sides of the Mexico–United States border, including the scene where United States Border Patrol Agent Brian Terry was killed in December 2010. The gunwalking operations became public in the aftermath of Terry's murder.[2] Dissenting ATF agents came forward to Congress in response.[17] According to Humberto Benítez Treviño, former Mexican Attorney General and chair of the justice committee in the Chamber of Deputies, related firearms have been found at numerous crime scenes in Mexico where at least 150 Mexican civilians were maimed or killed.[18] Revelations of gunwalking led to controversy in both countries, and diplomatic relations were damaged.[2]. . . "

This seems to be, yet one more case, where the dominant corporatist party, is accusing others for the very crime they do.

Scapegoating nonsense. Mexico needs to secure it's border not whine about Americans doing business in America.

Silly question. If it is the fault of the person receiving, not the one sending, why were all the Republicans insisting military action against the Cartels in Mexico was necessary?

Aside from the fact Mexican drug cartels are a national security threat?

Unreliable source, rightwing fake news.

ATF is not to ‘blame.’

Mehico still has plans of Reconquista...and they are working out pretty well. CA is gone. NM and TX are not too far off.

The irony is that it’s Congress’ responsibility to address this issue, where Congressional Republicans are opposed any such needed legislation; Congressional Republicans whose campaigns are bankrolled by the gun lobby and firearm manufacturers.

Fast And Furious Questions For U.S. Attorney General

".. . . He later declared Holder a hostile witness.

"The blame must go to your desk, and you must today take the real responsibility," Issa said. "Why haven't you terminated the many people involved?"

Issa also brought up a letter the Justice Department sent to Congress in February that said the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) moved whenever it could to seize guns before they went to Mexico.

But that turned out to be false, and the Justice Department retracted the statement.

Holder made clear he's since laid down the law. "Allowing guns to walk, whether in this administration or the prior one, is wholly unacceptable," he said. "The use of this misguided tactic is inexcusable, and it must never happen again."

Holder got some support from a group of big-city police chiefs in blue dress uniforms who were seated behind him.

Democrats on the panel also tried to intervene on the Republicans' line of fire.

Michigan Democratic Rep. John Conyers said, "If we're going to criticize ATF, I think we must work to revitalize it, not to tear it down."

The attorney general asked Congress to confirm a nominee to lead ATF to pass new laws against gun traffickers, and stop interfering with a rule that forces gun dealers in four border states to report multiple sales of long guns.

But Issa said Holder's priorities are in the wrong place.

"This administration is more interested in talking about gun control than actually controlling the drugs and guns that they had control over," Issa said.

Wisconsin Republican Jim Sensenbrenner got down to the bottom line when he asked, "What are you gonna do to clean up this mess?"

Holder replied, "Well, first let me make something very clear: Nobody in the Justice Department has lied. Nobody."

Sensenbrenner then asked why the Justice Department letter was withdrawn.

"The letter was withdrawn because [of] the information in there that was inaccurate," Holder said.

Sensenbrenner interjected to pursue his point: "OK, well, tell me: What's the difference between lying and misleading Congress in this context?"

Ok. To make sure I understand. It is perfectly fine for us to invade Mexico with the military, but outrageous for them to sue Americans in court using laws which have been on the books for decades. Is that your position?

Of course, Mexico has proven they are incapable of containing the harm caused to this country. Invasion and annihilation of the cartels is within our national interest. 100,000+ dead Americans from drugs smuggled from Mexico is all the justification needed.

Mexico should not even have standing in such a case, this is a gross miscarriage of justice.

So Americans broke the law by selling to Straw Purchasers. And the people who were harmed when these weapons were provided to criminals have no standing in your world.
