They can, but when a spouse of a member of The Congress is hired by the President, and s/he serves at the pleasure of the President, the member of Congress has a duty to recuse him or her self when any issue is congruent with their spouses office; if there is at least an appearance of a conflict, The Member of Congress must have the necessary integrity to recuse themselves from the debate, and any vote on such an issue.
