A man talking a woman into having sex with him is not committing rape. Forcing a woman to have sex is rape, except for married couples. You can't rape your wife. If someone is drunk can they be held to a contract they sign? Or a confession they give to police?
Enforcement of a contract is a civil issue not criminal. There are differences. As with most legal issues, the devil is in the details. Comparing sexual consent to a contract is an apples and oranges comparison.

Courts are usually not very sympathetic to people who claim they were intoxicated when they signed a contract. Generally a court will only allow the contract to be avoided if the other party to the contract knew about the intoxication and took advantage of the intoxicated person, or if the person was somehow involuntarily intoxicated (e.g. someone spiked the punch).

It depends on when they decide to become rape victims. If she has sex with Jimmy then finds out that her friends think he's a nerd, she wasn't raped.

If she has sex with Larry, then finds out that Larry has laid half of Phi Beta, she wasn't raped.

If she never had sex with the star quarterback but he said hello to her once in the hallway, she definitely wasn't raped.

Any rape victim with a story that is factual is entitled to have a day in court. If a rape victim claims being drunk and unable to consent, then she would have to say why she was drunk and unless drugged, then her drunk is hers and has no place in court.

And I'd advise her not to drink because she can't trust herself to make good choices.
