New York Attorney General Letitia James was indicted in federal court on Thursday as President Donald Trump’s Justice Department continues to pursue charges against his political opponents.

Specific details not yet available, but it sounds like mortgage fraud. Oh what a tangled web we weave.

Here’s an amusing thought. A bit premature. But amusing.

If the case goes to trial, naturally Letitia will have the right to remain silent. However, if she chooses to testify (which is also her right), I would assume that one of the first questions she may be asked is “what is your primary legal residence?” It would then be followed-up with “and “how long has that address been your primary legal residence?”

I also assume that she will HAVE to answer that whatever her NY State “home” is will be the address she would give. (Otherwise, she would immediately, under NY State law, be disqualified from being NY State’s AG.)

But in her Virginia mortgage application, she swore that the new Virginia house was being purchased to be her “primary” residence. Accordingly, she either lied under oath in the mortgage application OR she will be committing perjury to save her job in NY.

And, either way, she’s gonna get burned.

So, it seems obvious that she won’t be able (as a practical matter) to testify at all. Lots of defendants in criminal cases elect not to testify at their own trials. Nothing wrong with that. But she won’t have much of a choice.
