At that piont his deportation was on hold and he was here legally pening further action. The Trump Administration chose not to pursue deportation to a 3rd party country at the time meaning he was in a temporary legal status.

Again false, he dosen't have a rap sheet. He's never had been convicted or even charged with a crime in any criminal court either in the United States or El Salvador, excluding the current charges in TN which appear to have been a political ploy.
Get him back on trumped up charged, turn him over to ICE, deport him again (legally this time) to get him out of the country - then the TN charges get dismisseddd for lack of a defendant who is not outside the courts jurisdiction.
But oops - the actual judges are throwing a wrench into that plan. Judge Holmes (TN) has been holding Abrego Garcia in protective custody by the US Marshalls so he hasn't been turned over to ICE for deportation. Judge Xninis is due to rule today on the status of Abrego Garcia based on hearings (the order will be posted at the above link) held last Thursday and Friday. It's very likely she will bar DHS/ICE from deporting him again and require his appearance in her court.
This could be bad for the DOJ. Why? Because now they will be forced either to (A) it gives decnse full discovery in term of subpeona power for phone records, texts, emails, video, etc., (B) bringing the TN case to trial and actually have to present evidence in court that can be challenged, (C) or the Administration looks at their case and says they can't win it before a jury, so they drop the charges proving they had a bad case to begin with.
