Good luck getting people to choke a man unconscious over him throwing garbage and making a scene?

Well, that's certainly a way to down play it. Even the people on the subway said they felt like they were in danger.

But that's not what I was talking about, you know it. Penny didn't kill a man throwing garbage, he tried to subdue a man who was threatening people. My point was, the "good samaritans" will just hold their help for fear of things like this.

If someone robs a store ans kills someone in the process, and you had the ability to stop them, and you didn't, what will your stance be on that?

Johnny Grima repeatedly referred to Neely’s death as a “murder” and said Penny told him to stop when he tried to pour some water on Neely’s head.

“That’s weird. That’s wrong,” Grima said of Penny. “You’re not a police officer.”

If he were a black guy there would not be any charges. If he were an illegal he would be given a Medal of Honor. Passengers were scared for their lives. You lied. Why do you constantly lie?

Alethea Gittings, seen on body camera, testified that she thanked Daniel Penny and that he asked her to tell officers at the precinct, to which she replied, "Of course I will."

"The guy in the tan did take him down like, very respectfully and just like held. He just held him. Yeah, yeah, He just held him. He didn't choke him," Gittings said in body camera footage.

Two witnesses on the stand Friday who left the scene, only coming forward after learning Neely had died.

A mother on the train with her 5-year-old told the court that Neely was "very erratic and unpredictable."

She also said, "My son started asking me questions, 'why did he want to go to prison,' and also testified, "I actually took the stroller that I had and put it in front of my son to create a barrier."
