Penny stepped in and stopped him.

It would have been smarter for Penny just to let Neely do his worst and ignore what was going on. That's what DA Al Bragg expected him to do.

You get the world you demand. If they convict, good luck getting people to assist. If someone comes in to the store you're in to rob it, even though you might be concealed carrying, you don't dare intervene, and if that robber shoots and kills someone on the way out, even though you could have prevented it, that death is NOT on you.

It sounds like the problem is that they aren't allowed to consider the lesser count of manslaughter unless they come to a unanimous decision on the top count.

If it's just one guy holding out, then the judge could allow them to consider the lesser count.
