Judicial Watch Says It Has First-Hand Evidence From DC Police That Shooting Death of Ashli Babbitt Was 'Unjustified'

Judicial Watch has received first-hand evidence from the DC Metropolitan Police Department that the shooting death of Ashli Babbitt was “unjustified,” the conservative activist group announced on Nov.10.

The organization said in a statement that it has received new audio, video footage and photo records pertaining to the shooting death of Babbitt, including a cell phone video of the shooting itself, as well as a short police interview of the shooter, U.S. Capitol Police (USCP) officer, Lt. Michael Byrd.

Babbitt, 35, was among the crowd that breached the Capitol on Jan. 6, interrupting a joint session of Congress convened to certify the presidential election’s electoral votes. As she attempted to climb through a broken window into the Speaker’s Lobby, adjacent to the House chamber, she was shot by Byrd.

Babbitt, who was unarmed, was soon declared dead.

Judicial Watch obtained the material through a May 2021 Freedom of Information lawsuit.

Records include a new cell phone video, which has been edited by the DC Police and shows officers reacting to the shooting. The footage, which is 1.27 minutes long, depicts a chaotic scene as dozens of officers walk up a stairwell and approach a group of protestors inside the building before attempting to pull some of them away. The faces of those in the video have been blurred out however their voices can be heard.

The documents also include photos of the area where Babbitt died, which show broken glass and chairs piled up in the speaker’s lobby. There are also DC Police photographs of Byrd, his hands, and his gun, as well as pictures of a folding knife, which was allegedly found in Babbitt’s pocket.

There is also a 16 minute-and 40-second audio recording of police interviewing Byrd on the day of the incident. The voices in that interview and others have been digitally altered to try to hide the identities of those involved.

Byrd had defended shooting Babbitt and claimed that he issued verbal warnings before opening fire but admitted that he did not know Babbitt was unarmed.

“She was posing a threat to the United States House of Representatives,” Byrd said on NBC in August.

“I could not fully see her hands or what was in the backpack or what the intentions are,” Byrd said. “But they had shown violence leading up to that point,” he added.

Terrell Roberts, who is representing the Babbitt family, has told The Epoch Times that the killing was “a pretty clear case of shooting an unarmed person without any legal justification.”

Last month, Judicial Watch released records from the DC Police showing that multiple police officers claimed they did not see a weapon in Babbitt’s hand before Byrd shot her. One officer attested that he didn’t hear any verbal commands before Byrd fired at Babbitt.

Why would the police have left if the door way was such an important post, as you falsely claim.
The reality is the helmeted and machinegun armed police reserve were the one waiting around the corner of the stairway.
And the only reason to police at the top of the stair were backing off, is that they likely saw Bryd waving his gun at them and wanted to get out of the line of fire.
But they clearly did not go far, and it was one of the cops who got to Ashli on the ground first, to try to stop the bleeding from her neck.

The window Ashli was trying to go through was at the top of the stairs.
She wasn't on the stairs. The cops were walking away and down the stairs.

If the cops had moved away from the window, Ashli still would have been directly behind them and easily arrested, if they felt there was any need.
You're lying again. The stairs nearest her, go down a few stairs and then turn to the left, which is where the cops were. They were not directly behind her when she was shot.

The fact they were NOT trying to restrict that window any longer, proves there was no threat to anyone from crossing that window threshhold.
Otherwise the police would not have left.
Or it could mean they were warned to get away because lethal force might have been needed to keep that violent mob away from lawmakers.

And in fact, we know the police were not outnumbered, because down the stair, there were at least half a dozen helmeted cops with machine guns.
They came up immediately when they heard the shot.
So clearly there were an abundance of cops hidden in reserve, who were never needed, called, or used.

The first cop is seen returning to that area at 39:18. That's at least 6 seconds before the police returned. They were down the stairs. The one closest could have easily gotten back to where she was within 6 seconds. And it was 2 more seconds from when she first climbed up. So no, there was no cop near her, other than Byrd on the other side of the doors, to arrest her.

So when you say that image you posted was from the second she fell, you're absolutely lying.

The cops were a hands breath away from her when she was shot.
They could easily have arrested her instead of shooting her, and ONLY Bryd even had his weapon out.
Not one of the other police right there even considered her worth arresting.

The stairs do not just go down a few stairs before turning, because then the people going down the stair would hit their heads at the turn.
Obviously the stairs have to drops a full 7' at least, before turning.
And in all the images, you can not even see the turn.
Clearly the cops could not have vacated the stairs and made the turn, since they were immediately at Ashi and attempting to stop the bleeding, before anyone else could even get to her.

Obviously lethal force was never needed because even if congress people had been right on the other side of the barricaded door, there were plenty of police to protect the door if they wanted to.
Clearly the police did NOT want to protect that door any longer, so that can only mean the House Floor was not longer occupied by any congress people.

And when ever we see images the House Floor, it is almost empty.

Here's yet even more proof you're lying that the cops were already there as she fell. In the image you post, there's a guy wearing an olive colored hoody standing above her, to her left.

Again, here's video where she can be seen falling at 39:12. The guy with the olive colored hoody isn't seen until he walks up to her to help at 39:24. At 39:35, the guy in the suit looks like he's pointing down, just as he is in the image you posted.

So that image you posted is somewhere 12 seconds and 23 seconds after she fell to the floor. Meanwhile, you lied and said, "here is Ashli at the second she falls to the floor, and the cops are already there."

That's a provable lie as there is no video showing "dozens of officers" walking up the stairwell. There was a total of 7 identifiable officers. There were 3 standing guard in front of the doors. Those same 3 then walked to the side. At about that time, 4 more heavily armed cops came up the stairwell and escorted the first 3 cops out of there. 1 of the heavily armed cops did remain near the top of the stairs when Ashes was shot. Another was further down at a landing where the stair well turned around a corner (a corner you idiotically denied was there). The other 5 had already turned that corner and were on their way down the stairwell.

The other officers on Byrd's side of tbe door didn't have a clean shot like Byrd did.
