If the interviewer determines that they have a legitimate reason to be in the country then they will be given a court date. They do not automatically get time in court.

No child if you do not come in through a port of entry then you are immediately considered to have no real reason to be here. They can still interview you and decide if you have a real reason but the fact you did not come through a port actually works against your claim.
There is no requirement that you get a court date.
