There is no loophole regarding background checks. It has ALWAYS been legal for private individuals to buy, sell and trade firearms without government regulation, the same goes for knives, chain saws, cars, lawn-mowers, etc. Do you run background checks on people you sell your stuff to? Didn't think so.

It wasn't until the mid 20th century that government decided that they had to regulate people "in the business" of selling firearms...and it wasn't until the late 20th century that they added background checks to the myriad of requirements for dealers to sell their firearms. This notion that something that has always been perfectly legal is some kind of "loophole" just shows how you people are either willfully ignorant on the subject, or just plain lying through your teeth.
