He is chanrged with FALSIFYING BUSINESS RECORDS IN THE FIRST DEGREE, in violation of Penal Law §175.10...He is being charged with something that isn't a crime, so yeah.
A person is guilty of falsifying business records in the first degree when he commits the crime of falsifying business records in the second degree, and when his intent to defraud includes an intent to commit another crime or to aid or conceal the commission thereof.
Falsifying business records in the first degree is a class E felony.
Upon conviction, a court can sentence you to up to four years in prison. While incarceration is mandatory for predicate felons, if you do not have a felony in the previous ten years a judge can nonetheless "lock you up" for the same amount of time.

What does make the case weak is the witnesses and their character and the fact that the statute of limitations has expired... and the fact that its not a criminal case......but Lakhota was honestly pointing out that that does not necessarily make it the weakest case.

Ask yourself 1) what business records Trump allegedly falsified and 2) how are they going to prove the underlying crime of Campaign finance violation when Biden own FEC said it wasn't (and in light of the Edwards case.)
