To my knowledge Trump did not issue his own. EO so this would still stands.

Yes the president can declassify. The process is outlined in the EO that must be followed.

The key one is that the originator should be notified and if the originator disagrees then they can present their reason for it to remain classified to the president. The president can agree or disagree.

If still affirmed, then there is a process to declassify. If others and the originator have copies of the same document, how are they going to know that it has been declassified if the President just thinks it should be and not tells them.


Trump speaks with double tongued when he says he can declassify just by thinking it and then remove documents to his home.

He didn't follow the rules

He then brags about having sensitive documents.

No person is above the law.

What is said on the tape will have other collaborating evidence to make the case stronger.

Trump admits on the tape that they are classified documents and it can be used in court. Isn't that freedom of speech? Prosecutors love defendants who admit their crime. It makes it so much easier.

Since there are other people in the room then there is collaborating evidence that it was Trump who said it.

The classified documents retrieved from hi home is collaborating evidence.

NARA requesting that he turn over the documents is evidence.

Even the people who moved the boxes can testify that they were taken out of the Whitehouse on an order by Trump.

Trump denying that he had classified documents will be show that he is a liar.

This case does not rest on one piece of evidence.

While I will say for the record, I don’t like being loose lipped with confidential information, and if proven that he was showing said information to a writer, then he should pay the price.

But, Smith has to prove it first. And, his track record is not strong in that dept.

Well it's obvious in the tape that he is talking to someone. If no one else is in the room then he is going crazy.

So it would be a safe bet that one or more people were in the room. They would testify that the tape is authentic and maybe add other things. That is raising it to a level of beyond a shadow of doubt.

Most courts will allow audio tapes if chain of custody can be proven. Audio tapes can also be submitted to forensic experts who can testify on what they find.

Obvious they have to raise it beyond a shadow of doubt or it could lead to a hung jury.

Classification marking on documents are clear.


Now if you want to believe that Trump is innocent then that is what you believe. This is what Trump faces in a court of law.

Proof beyond a reasonable doubt. But it won't matter to the person who believes that Trump is innocent.

Yes that was a mistake on his part. The difference is he notified the proper people that he had them. And they pick it up.

versus Trump who was repeatedly asked to turn over the document. he turned over a few boxes and then said that was all he had. He lied and kept the rest. He refused to turn over all the documents when asked.

There is a difference

The person who turns himself him in has a chance to get a lessor punishment that the person who had to be captured. .

The range of sentencing is given to judges so that they can impose punishment suitable for the circumstances of the offense.

A mistake? That wasn't a mistake he intentionally took documents that he knew he wasn't allowed to take.
