You are correct. Immigration is an Executive Branch function. Congress makes the law and the Executive Branch carries it out. Immigration Judges are administrators operating under authority of the Executive Branch, not the Judicial Branch. The President and Attorney General control them, not the Chief Justice.

Our Judicial branch has been going out of control for a long time. Something needs to be done. Any legal issue having to do with ICE's definition of 'due process' is for ICE to sort out. Not the Congress or SCOTUS.

Like the judge who "ruled" deportable illegals need to be given 21 days notice, when our law specifically states 10 days (it's in the US Code).

Judges like that should be impeached, because they don't know the law. Legislating from the bench often occurs out of sheer ignorance.

Leftards whining about due process need to understand the immigration judges are administrators, nothing more. They operate out of the Executive Office for Immigration Review, which is part of the DOJ. They handle cases under the authority of the Attorney General.


 
Due process, for what? Telling an illegal immigrant they are not welcome and escorting them out of the country is not in any way, shape, or form worthy of due process.

If they are not charged with anything, they should be able to be escorted out without any type of hearing.

To the topic, everyone alive and standing on US territory has the right to due process. That DP may be brief and rudimentary, but every man, woman, child, and person who owns cats is entitled to that. Its a basic, fundamental precept of our republic. We are citizens, NOT subjects.

Our system of justice is predicated on the idea that it's better for a guilty person to go free than an innocent man getting convicted of something he/she didn't do. That is the reason why we have due process, to do the best we can to make sure that mistakes aren't made or at least eliminated as much as possible. And i believe that holds true for illegals too.

Person A gets arrested in an Attempt ICE sweep. He says, ā€œbut but but, you can’t deport me anywhere! I’m an America can citizen!ā€

Minimally, the process which is due to him requires that our government establish (very well) that he is actually an alien (as well as being an alien who is subject to our deportation laws).
It’s up to the person to prove he’s here legally.

Let’s say, for example, that ICE grabs me as I am paying for my new shoes at MACY’s and claims I’m here illegally. They can follow me home, where I will show them my birth certificate. Problem solved.

I don’t agree. If you’re stopped by a cop for ā€œspeeding,ā€ you aren’t called upon to prove you weren’t. It’s up to law enforcement and the prosecutor to prove you were.

Now, granted, that you is a criminal setting and immigration is not criminal. It’s civil and administrative. But still, Congress itself explicitly granted the right of a hearing to immigrants (legal or illegal). Therefore, the ā€œrightā€ to the hearing itself is a fairly minimal kind of due process. But the rules don’t care. The ā€œaccuserā€ is still the one with the burden of persuasion.

Would you or I quickly try to get our hands on our birth certificate? I expect so. But we wouldn’t have to.

In Oklahoma City Thursday, about 20 federal immigration agents raided the wrong home, forcing a woman out of the house with her three daughters, not even leaving them enough time to get dressed, and then seized their phones, laptops, and life savings.

ā€œIt was so denigrating. That you do all of this to a family, to women, your fellow citizens. And it was ā€˜a little rough’? You literally traumatized me and my daughters for life. We’re going to have to go get help or get over this somehow,ā€ Marisa said. The agents told her that it could take days or months for the family’s stuff to be returned, and wouldn’t even give her a business card.

It all fits a pattern of cruelty from the Trump administration in its efforts to deport as many people as it can. The White House doesn’t believe in due process or following the law, or even standards of basic decency. The violent raid in Oklahoma City would be wrong even against a family of undocumented immigrants, let alone U.S. citizens like Marisa and her daughters. Hopefully, she and other victims of the administration’s wanton behavior can get restitution.
