Just to follow up. The exceptions (ie 240 and 244) address different matters and don’t need undercut the claim you made.

Unless there’s something (else) I’m missing, I have to acknowledge that you supported your claim (at least as to inadmissible aliens here less than two years) as being well supported.

Nope. Since they aren’t Article III Courts, the fact that we mislabel them as being “courts” doesn’t change what they are. And we can call any administrative hearing officer “judge,” but they aren’t real judges.

They most certainly are "real" judges. They are called Administrative Law Judges (ALJs). There are over 2,000 ALJs in the Federal gvt. (well over twice as many as there are Article III judges) The bulk of the disputes with the Federal gvt are adjudicated by ALJs.



In the United States, the United States Supreme Court has recognized that the role of a federal administrative law judge is "functionally comparable" to that of an Article III judge. An ALJ's powers are often, if not generally, comparable to those of a trial judge, as ALJs may issue subpoenas, rule on proffers of evidence, regulate the course of the hearing, and make or recommend decisions.

They are called judges. I already noted that.

But they are absolutely not real judges.

Real judges are Arricle III judges.

I see no point in continuing that facet of this conversation.
