The DOJ and FBI should be able to request Congress meet with them behind closed doors to discuss details of ongoing investigations and/or other sensitive matters that would be endangered by media coverage including people who don't deserve being dragged through the mud.

President Jackson probably understood that it is not the function of the Supreme Court to make law. It is the function of the court to interpret existing law. The court is not given authority to declare any law null and void but can say that it is unconstitutional. But it has no power to enforce an opinion.

This is to say that the fact that a law is unconstitutional should be addressed by the people's elected representatives who can and who ethically must rescind or change it. Until it is changed, it is constitutionally still the law.

I’m loathe to take sides with a scumbag like Meritless Garland or our present day DOJ. But it is my understanding that they have a policy — as a matter of course — of refusing to comply with subpoenas and so forth relative to ongoing investigations

Of course, where the matters being investigated include a legitimate concern about the possible politicization of how the DOJ goes about its duties, the refusal of the DOJ to comply becomes a lot more problematic.

What the House needs to do is simply cut off all funds from the DOJ until it cooperates. The budget is being negotiated along with the debt ceiling. Just refuse to negotiate at all until the DOJ actually delivers the documentation and witnesses requested. Then add a rider to the budget allowing funds to be cut off from any agency that refuses to cooperate with congressional subpoenas. Use the power of the purse as a bludgeon against run-away agencies.
