No one ever thought the President had immunity for official acts before, as this was a landmark SCOTUS decision which was invented whole cloth (nothing in the constitution says anything about immunity for the President).

The charges weren’t thrown out. Smith returned to court with a slightly altered indictment because Trump’s fraudulent attempt to steal an election was not an official act.

Nowhere does the constitution say the president is immune from prosecution for official acts. SCOTUS had to invent this.

Regardless, Smith filed an amended indictment after the immunity decision with the exact same 4 charges as before. SCOTUS didn’t find the charges unconstitutional at all, because fraudulently stealing an election is not an official act.

You still haven’t handled any of the facts and evidence.
